These disclosures describe important facts about FundYourEdge, Inc. and the nature of our evaluation and simulated funded-trading programs. They are part of, and should be read together with, our Terms of Service.
1. Risk warning
Trading involves substantial risk
Trading futures and other leveraged products involves substantial risk and is not suitable for all investors. You should carefully consider whether such activity is appropriate for you in light of your circumstances and financial resources.
2. About FundYourEdge
FundYourEdge is a Wyoming corporation. FundYourEdge is not a broker-dealer, futures commission merchant, commodity pool operator, commodity trading advisor, or registered investment adviser, and does not provide investment, tax, legal, or accounting advice. FundYourEdge is approved as a Third-Party Assessment Provider by CME Group.
3. Simulated environment
All trading conducted through the FundYourEdge platform takes place in a simulated environment using virtual funds — no real capital is deployed at any stage of the evaluation or funded phases. References to "funded accounts" or "capital" describe simulated trading allocations only. Performance-based payouts are discretionary compensation paid at FundYourEdge's sole discretion and do not constitute returns on investment. Participants are independent contractors, not employees of FundYourEdge. Trading futures involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results.
4. Not financial advice
Nothing on our website or within the Services is investment, financial, tax, legal, or accounting advice, or a recommendation to buy, sell, or hold any financial instrument. You are solely responsible for your own trading decisions.
5. No guarantee of payouts
Passing an evaluation does not guarantee any payout. Performance-based payouts are discretionary and are subject to the rules and conditions described in your account agreement and on our website.
6. Eligibility & geographic restrictions
The Services are offered from the United States and are not directed to anyone in a jurisdiction where their use would be unlawful or where we do not offer them. We may restrict access from certain jurisdictions as required by applicable law. See our Terms of Service for eligibility requirements.
7. CFTC Rule 4.41 — Hypothetical or simulated performance results
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY.
